Under penalty of cancellation of the insurance policy, the renter agrees:

• not to allow the car to be driven by other persons than himself or those approved by IMPRESSIO LINE LTD and whom he is answering for;
• to use the vehicle only for his requirements;
• to take part in no competition;
• not to use the vehicle for unlawful purposes or for the transportation of goods;
• not to push or tow any vehicle or trailer;
• not to take passengers;
• not to overload the rented vehicle by taking a number of passengers above the one stated on the car license.

The car is delivered in perfect working order and in absolutely clean condition. The odometers and their connections are sealed and the seals are not to be carried off or broken. Otherwise, the rental shall be paid on the standard rate of 200km a day. The vehicle shall be returned in the same condition of neatness, otherwise renter shall have to pay the cleaning and over-hauling cost. The tires are in fair condition without cut. In case of damage to any of the tires for a reason other than normal wear and tear, renter agrees to replace it at once by a tire of same and or an obviously similar wear.

Damage or loss of equipment is not covered by either the Insurance deposit or by the insurance waiver charge and is thereby the responsibility of the hirer.

Gasoline shall be chargeable to customer; renter has to regularly check the oil and water-levels. He shall warrant any additions by correspondence bills.

Normal mechanic, wear and tear is IMPRESSIO LINE LTD responsibility. Any and all repairs arising from abnormal wear and tear due to want of care on the part of the renter shall be chargeable to him and carried out by us in the event of immobilization of the vehicle. The repairs shall be carried out only after written approval and according to instructions of IMPRESSIO LINE LTD. The repairs must be fully itemized in receipted bill, the replaced defective parts ought to be produced together with the receipted invoice. Under no circumstances, shall the renter be able to claim indemnity, either for delay in delivering the car, cancellation of hiring or immobilization in the event of repairs carried out during the renting term. IMPRESSIO LINE LTD shall never be held liable, even in the case of accidents of persons or property arising out of defects or defaults in construction or in former repairs.

Only the drivers authorized by IMPRESSIO LINE LTD are entitled to be insured. They are insured against the following risks:

• For an unlimited amount against accidents causing bodily injury any or death to third parties; including those they carried free of charge, but exclusive of renter and driver and of, when they are in IMPRESSIO LINE LTD car, the wife or the husband, the ascendants and offspring of the renter or of the authorized driver.
  
  
• Against theft and burning of the rented vehicle. Unless it is due to obvious want of care on the part of the renter.
  
  
• Against damages to the car, however with an excess of Rs. 20,000 remaining owed by the renter in the event of an accident.

(i) To report within 24 hours to IMPRESSIO LINE LTD and at once to the police Authorities, any accident, theft of fire occurred even partial;

b) To mention in this report the circumstances, place of accident, names and addresses of the witnesses car’s number of the opposing party as well as the name of his insurance and the number of his policy.

c) To attach to the report any police statement or affidavit made by the prosecutor, if any.

d) To refrain from admitting any responsibility, from dealing or compounding with third parties regarding the accident.

(ii) Clothes, if any and all items carried in the car are not covered;

(iii) The car is insured only for the length of the rental. At the end of this term and only if the prolongation has been accepted, IMPRESSIO LINE LTD declines any liability for the accident renter might have occasioned which he personally shall have to deal with.

(iv) IMPRESSIO LINE LTD, declines any liability for injuries to third parties or accidents to the car renter might cause during the length of rental agreement if renter intentionally provided IMPRESSIO LINE LTD with false information in respect of his identity, his address or the validity of his driving licence, and there is no valid insurance in this case.

(v) Lastly, there is no insurance at all for any driver who does not possess a valid driving licence. Moreover insurance for damages to the rented vehicle and personal accident is cancelled if the driver is in a drunken state.

The rental fees as well as the deposit amount are fixed by the rates in force and are payable in advance. In no case, the deposit can be used or a prolongation of the hiring. In the event the renter should want to prolong the agreement and only with IMPRESSIO LINE LTD consent he shall have to forward the amount of the rental in progress otherwise he may be liable to judicial prosecution for misappropriation, of a car or embezzlement. Interest will be charged at 2% per month on all unpaid balance from the due date. In case any amount due by the renter to IMPRESSIO LINE LTD has to be recovered though an attorney, the commission of 10% payable to the attorney, will be paid by him.

Renter expressly prohibits himself form abandoning the vehicle. In the event of material impossibility the car shall be repatriated by IMPRESSIO LINE LTD at the renter’s expense, the rental being due until the return of the vehicle.

Immediately on the termination of the hiring and the return of the car, renter shall deliver the licence and all the documents required for its running, failing which the rental charge shall continue to be invoiced until their delivery to IMPRESSIO LINE LTD.

Renter remains solely liable for any fines, report and official statements drawn up against him.

Any and all disputes which may arise between IMPRESSIO LINE LTD and the renter shall fall under the exclusive jurisdiction of the Court of Mauritius.

IMPRESSIO LINE LTD reserves the right to claim back its vehicle in case the renter do not abide to our terms and conditions.
